Welcome to Ohana Property Solutions LLC. These Terms and Conditions ("Terms") govern your use of our website at https://www.opshawaii.com (the "Site") and the services we provide through it. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

These Terms do not, by themselves, create a contract for construction services. Any agreement to perform work is governed by a separate signed contract or written estimate-acceptance between Ohana Property Solutions LLC and the client.

1. About Us

Ohana Property Solutions LLC ("OPS Hawaii," "OPS," "Company," "we," "our," or "us") is a Hawaii limited liability company providing residential and commercial renovation, handyman services, project management, specialty finishes (including microcement, limewash, Venetian plaster, and similar coatings), leak detection, real estate-related repair and due-diligence support, and related construction services on the island of Oʻahu.

We are not a financial advisor, investment advisor, lender, mortgage broker, or real estate broker. Nothing on this Site constitutes financial, investment, legal, tax, or real estate advice.

2. Use of the Website

You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Site in any way that violates applicable federal, state, or local law or regulation

  • Attempt unauthorized access to the Site, its server, or any connected systems

  • Use any automated means (bots, scrapers, crawlers) to extract data from the Site without our written consent

  • Upload or transmit viruses, malware, or other harmful code

  • Interfere with the operation or security of the Site

  • Impersonate any person or misrepresent your affiliation with any person or entity

  • Use the Site to harass, threaten, or harm any person

We reserve the right to refuse service, suspend access, or remove content at our discretion.

3. Quotes, Estimates, and Service Requests

Information you submit through the Site (contact forms, intake forms, project descriptions, photos) is used to evaluate your project and to follow up with you. Any quote, estimate, price range, or scope of work communicated through the Site, by email, by text message, or in conversation is preliminary and non-binding until:

  • A written estimate or proposal has been signed by both parties, or

  • A separate written contract has been executed by both parties.

Preliminary pricing is subject to site conditions, access, material availability, lead times, permitting, AOAO/HOA approval, weather, and other factors that may not be known until a site visit or further investigation. Final scope, price, schedule, and warranty are governed solely by the signed contract or estimate-acceptance, not by these Terms or by anything on the Site.

4. Intellectual Property

All content on the Site — including services, text, photographs, illustrations, logos, graphics, video, software, and the OPS Hawaii name and marks — is the property of Ohana Property Solutions LLC or its licensors and is protected by U.S. and international intellectual property laws. You may not reproduce, distribute, modify, publicly display, create derivative works of, or commercially use any content from the Site without our prior written consent. Project photographs depicting your property may be used in OPS marketing only as permitted in your signed contract; you may opt out of marketing use in writing.

5. User Submissions

By submitting any content to the Site or to OPS — including project descriptions, photographs, drawings, inspection reports, documents, or messages — you represent that you have the right to share that content and you grant OPS a non-exclusive, royalty-free license to use it for the purpose of responding to your inquiry, performing services, maintaining business records, and complying with legal obligations. You are responsible for ensuring that submissions do not infringe any third party's rights or violate any law.

6. Disclaimers

THE SITE AND ALL CONTENT, INFORMATION, AND MATERIALS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, OPS DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.

We do not warrant that the Site will be uninterrupted, secure, error-free, or free of viruses. Information on the Site is provided for general information only and may not reflect current pricing, availability, code requirements, or site-specific conditions. Any reliance on information from the Site is at your own risk.

Warranties applicable to actual construction work performed by OPS are governed solely by the signed contract for that work, and not by these Terms.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, OHANA PROPERTY SOLUTIONS LLC, ITS MEMBERS, MANAGERS, EMPLOYEES, AND CONTRACTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE SHALL NOT EXCEED ONE HUNDRED DOLLARS (US $100). THIS LIMITATION DOES NOT APPLY TO LIABILITY THAT CANNOT BE LIMITED OR EXCLUDED UNDER APPLICABLE LAW.

Nothing in this Section limits liability under any signed construction contract between you and OPS; that contract governs liability for work performed.

8. Indemnification

You agree to indemnify, defend, and hold harmless Ohana Property Solutions LLC, its members, managers, employees, and contractors from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Site in violation of these Terms; (b) your violation of any law or any third party's rights; or (c) content you submit through the Site.

9. Privacy

Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and protect your information. By using the Site, you consent to that processing and represent that all information you provide is accurate.

10. SMS / Text Message Terms

By providing your mobile phone number to OPS through the Site, intake forms, contracts, or in conversation, you expressly consent to receive text messages (SMS or MMS) from Ohana Property Solutions LLC related to your inquiry, project, scheduling, materials/deliveries, invoices, account activity, and (only if separately opted in) marketing.

  • Message frequency varies based on your project and interaction with us.

  • Message and data rates may apply.

  • Reply STOP to any message to opt out. You will receive one confirmation message and will no longer receive SMS communications unless you re-subscribe.

  • Reply HELP to any message, email OPS@opshawaii.com, or call +1 (808) 439-3605 for assistance.

  • Mobile carriers are not liable for delayed or undelivered messages.

  • We will not share your mobile phone number, SMS opt-in data, or text-message consent with any third parties or affiliates for their marketing purposes.

11. Third-Party Links

The Site may contain links to third-party websites or services that are not owned or controlled by OPS. We are not responsible for the content, privacy practices, or business practices of any third-party site. You access third-party sites at your own risk.

12. Eligibility

By using the Site and submitting any form on the Site, you confirm that you are at least 18 years of age. If you are under 18, you are not permitted to use the Site or provide personal information. We do not knowingly collect information from individuals under 18.

13. Electronic Communications

You consent to receive communications from OPS electronically — by email, text message, or notice posted on the Site — and you agree that all agreements, notices, disclosures, and other communications we provide to you electronically satisfy any legal requirement that such communications be in writing.

14. Governing Law and Venue

These Terms are governed by the laws of the State of Hawaii, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or related to the Site or these Terms shall be brought exclusively in the state or federal courts located in Honolulu, Hawaii, and you consent to personal jurisdiction in those courts. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

15. Force Majeure

OPS is not liable for any failure or delay in performance related to the Site or any communications caused by events beyond our reasonable control, including acts of God, natural disasters, hurricanes, tsunamis, severe weather, fire, flood, pandemic, government action, supply-chain disruption, shipping delay, labor shortage, utility failure, or internet outage.

16. Changes to These Terms

We may amend these Terms at any time. The "Last Updated" date at the top of these Terms reflects the most recent revision. Material changes will be posted on this page. Your continued use of the Site after changes are posted constitutes your acceptance of the updated Terms.

17. Severability; Entire Agreement; No Waiver; Assignment

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect. These Terms, together with our Privacy Policy and any signed contract between you and OPS, constitute the entire agreement between you and OPS regarding the Site. Our failure to enforce any provision is not a waiver of that provision. You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, sale, financing, or reorganization of our business.

18. Termination

We may suspend or terminate your access to the Site at any time, without notice, for any reason, including violation of these Terms. Sections that by their nature should survive termination (including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Governing Law, and this Section) will survive.
